This legislation introduces inspection obligations at various key stages of the work, requiring project owners to have their projects inspected by qualified professionals.

Main provisions of Bill No. 76:

Inspection obligations:

Project owners, whether they are owner-builders or builder-owners, must now have their construction work inspected at least at three key stages of the process. This measure aims to detect and correct any non-compliance issues from the early phases of the project.

Surveillance Plan:

The development of a monitoring plan is now mandatory to oversee the conduct of inspections. This plan outlines the procedures to follow to ensure rigorous and systematic supervision of the work.

Certificate of Compliance:

Upon completion of the work, a certificate of compliance with the standards of the Building Code or municipal standards must be obtained. This certificate, issued by a recognized professional, ensures that the construction meets the current regulatory requirements.

Commitment of qualified professionals:

Inspections and compliance certification must be carried out by duly accredited professional architects, engineers, or technologists, thereby ensuring appropriate technical expertise.

Mandatory training:

Contractors and owner-builders are required to complete specific training for obtaining or renewing their license, thereby enhancing their skills in quality and safety.

Increased powers of the Quebec Building Authority (RBQ):

The RBQ is being given new tools to intervene in cases of poorly executed work, including the ability to impose immediate corrective measures and monetary administrative penalties to ensure a quick return to compliance.
